Nevada Crimes by NRS Code Section
Nevada Crimes by Code Section
In Nevada, State lawmakers from the Senate and Assembly have enacted legislation, or “laws,” that in theory give rise to the ability for State Government to file criminal charges when necessary and appropriate. A majority of these crimes are governed by the Nevada Revised Statutes or “NRS” as they are commonly referred. The Nevada Revised Statutes “codify” the laws and allow prosecutorial agencies, such as the District Attorney’s Office or Attorney General’s office, to initiate the filing of formal criminal charges in a Court of law. Once a charge is filed, the person accused, known as the Defendant, will receive a copy of the filed charges in a document called a Criminal Complaint. The Nevada Revised Statutes is broken down by title and chapter. The portions of the NRS dealing with “Crime and Punishment” are found in Title 15 of the Nevada Revised Statutes. The individual crimes detailed in Title 15 are broken down even further by chapter, having to do with the type of crime alleged. These chapters are as follows:
Title 15 – Crimes and Punishments
- Chapter 193: General Provisions
- Chapter 194: Persons Liable to Punishment for Crime
- Chapter 195: Parties to Crimes
- Chapter 196: Crimes Against the Sovereignty of This State
- Chapter 197: Crimes By and Against the Executive Power of This State
- Chapter 198: Crimes Against the Legislative Power
- Chapter 199: Crimes Against Public Justice
- Chapter 200: Crimes Against the Person
- Chapter 201: Crimes Against Public Decency and Good Morals
- Chapter 202: Crimes Against Public Health and Safety
- Chapter 203: Crimes Against the Public Peace
- Chapter 204: Crimes Against the Revenue and Property of This State
- Chapter 205: Crimes Against Property
- Chapter 205A: Technological Crime Advisory Board
- Chapter 206: Malicious Mischief
- Chapter 207: Miscellaneous Crimes
There are thousands upon thousands of criminal charges filed every year in Las Vegas and throughout the State of Nevada. Navigating and understanding the law as it relates to these crimes is confusing and in most cases extremely frightening for the person charged. The following portion of the website of Hofland & Tomsheck and Certified Criminal Law Specialist Josh Tomsheck is meant to be a resource to those visiting this site so that they can understand the “nuts and bolts” of the crime charged, the elements the State has to prove in order to convict someone of the crime contained in the charging document and to highlight some of the potential defenses to the crimes alleged. This is not an exhaustive list and it is important to remember that each and every case is different, both factually and legally. Should you have questions about crimes in Nevada and how best to defend them, it is recommended that you consult with an experienced Las Vegas Criminal Attorney right away.
